Healthcare practices outsource for the same reasons as any business: lower costs, more coverage and fewer hiring headaches. The difference is that much of the work, from scheduling to billing to claims, involves protected health information (PHI). That brings HIPAA into every decision.

The good news is that HIPAA does not stop you from outsourcing. It sets the rules for doing it safely. This checklist walks through what to put in place before a single patient record is shared.

1. Sign a business associate agreement

Any outside company that creates, receives, stores or transmits PHI on your behalf is a business associate under HIPAA. Before they start, you need a signed business associate agreement (BAA) that spells out how they may use the data, the safeguards they must keep, and what happens if something goes wrong.

  • Permitted uses and disclosures of PHI, and nothing beyond them.
  • A commitment to the HIPAA Security Rule safeguards.
  • Breach reporting duties and timelines back to you.
  • Flow down terms for any subcontractors who touch the data.
  • Return or destruction of PHI when the contract ends.

2. Confirm the team is trained, and how

HIPAA requires workforce training, and that applies to your vendor's people too. Ask how and when staff are trained, how often training is refreshed, and whether it covers your own policies as well as the law. At Blockchain BPO, every team member is trained on HIPAA law and best practice before they see a client's workflow.

3. Apply the minimum necessary rule

Give your outsourced team access to only the information they need to do their job. A scheduler does not need full clinical notes; a payment poster does not need diagnosis history. Role-based accounts in your EHR and practice management system make this simple to enforce.

4. Keep data inside your systems

The safest setup is one where your team works directly in your own systems, with accounts you create, monitor and can switch off at any time. Avoid arrangements where patient files are emailed, downloaded or copied into a vendor's separate tools.

  • Individual logins for every team member, never shared accounts.
  • Multi-factor authentication on every system that holds PHI.
  • Audit logs you can review, so you know who accessed what and when.
  • Encrypted connections, such as a VPN or secure virtual desktop.

5. Check the physical safeguards

The HIPAA Security Rule covers physical safeguards as well as technical ones. Ask where the team works and how the office is secured. Look for controlled entry such as badge access, policies against phones and paper at workstations, and screens positioned away from public view. All of our international offices use electronic badge access locks.

6. Understand the offshore questions

HIPAA does not ban offshore work, but you remain responsible for protecting PHI wherever it is handled. Some government programs and payer contracts add their own limits on offshore access to certain data, so review your contracts before you decide which work goes where.

Working with a provider that is owned and managed in the US helps here. You have a domestic partner who signs the BAA, answers for the team and understands US expectations.

7. Plan for incidents before they happen

Agree in advance how a suspected breach will be reported, who investigates and how fast. Under the Breach Notification Rule, affected individuals must be notified without unreasonable delay and no later than 60 days after a breach is discovered, so your vendor needs to tell you quickly.

Your quick checklist

  1. Signed business associate agreement in place.
  2. HIPAA training confirmed for every team member.
  3. Access limited to the minimum necessary.
  4. Work done inside your systems with individual, monitored accounts.
  5. Secured offices with controlled entry.
  6. Offshore limits in your contracts reviewed.
  7. Incident response and breach reporting agreed.

Done well, outsourcing can actually strengthen your compliance, because responsibilities are written down and access is deliberate. If you would like to see how a HIPAA trained, dedicated team fits your practice, schedule a call with us.
